How old does a child have to be to choose who they live with?

  • 18yrs. old. Until then a child has no choice who they live with.

    The age at which they can go before a judge and express a preference varies from state to state. Even then it is up to the judge as to whether or not they chose to grant the child's request.

  • 12 yrs old. In most states the judge allows the child to testify and tell why they want to live with the other parent. If they have a good reason the judge 90% of the time agrees with the child. By the time a child reaches teen years it is very hard to dictate where they will live and a judge knows this. They are at greater risk of running away and running to the other parents if they feel they should live with the other parent. This is why judges listen at this age to the child & generally let them choose.
    Now on the flipside it is sad to even have to ask your parent to let you live with the other parent. I think p arents should be the ones listening to their children, instead of judges.

  • I'm pretty sure it is 13 yrs old. My husband's ex has a daughter that just turned 13 and she decided she didn't want to have anything to do with her father because he's a jerk.

  • As far as I know...in most states the court will at least seriously consider the preferneces of a child over 12.
