Get the baby back

If someone gives a baby up and lies bout who the dad is even if she knows and pretend she dont know can she get the baby back.

  • It seems that no matter what the circumstance or how much paperwork is signed biomoms have the ability to get the child back. They are in control.

  • up to three months i believe the birth mother can change her mind. As far as the father, he can request DNA testing and prove hes the father and never signed over his parental rights. It is his child as much as hers. The decision should be his as well!

  • meooma~ that is not true at all. This is why an mom considering adoption should do alot of research and have alot of counseing before she signs paperwork, because afterward she looses that control.
    OP~ depends on the state the adoption is taking place in. All states have different laws regarding the birth father. Ethically, the person adopting the baby should really try and find the father to make sure he agrees to the adoption.

  • It is interesting how many answer not really informed about adoption laws. My son's biological mother can attempt to file a petition for custody and to reverse the adoption at any time. Will a lawyer take her case? Probably not. Would a judge decide in her favor? Most likely not. In any state any biological parent has the legal right to try. In many states they have moved to, or are moving to, legal consequences for a birth mother who has lied or deceived the court about the father's identity. A biological father usually has to prove he was lied to, that he attempted to support tge child or woman during prgnancy, and is capable of parenting. I agree lying about a father is criminal and should be in all matters. Every child deserves the truth. Every adoptive parent derserves to know the truth. Those lies impact so many people. Ruining and devestating lives should not be an option.

  • No. If the adoption is finalized she cannot get the child back. However, there is a slim possibility that the father might be able to get the child, but I mean slim.

  • It really depends on the state but generally, once the waiting period (when the mom can change her mind) has expired there is no going back. However, if the real bio father never signed his rights away, HE can get the child, and then if he wants, he can let the bio mom adopt the child.

  • Frogdawg the OP asked if she could get the baby back not if she could try. There is a difference there and i was responding to that, not if she was allowed to try. Of course she could try, will she achieve her goal, probably not. This is why all adoptions should be done ethically then you never have to worry if your baby will be taken away. I believe people that do that are always looking over their shoulder. If OP lives in Utah no worries, they keep parents who want their children apart all the time. :(

  • She only lied because the dad beat on his other kids and beats on her. Now he changed and he cant have his other kids so he wants this one.
