Apartment renting question

My soon to be 19 year old put $200 down as a deposit/hold on an apartment. He sogned some paper work. However I have since found out there are alot of other fees he did not know of, needs renters insurance, trash pick up, community water and now doesn't want the apartment. He says he will loose the $200 but I asked to see the paper work and he says they have it. He didn't even get a copy. Is this legal? Will he loose the $200?

  • Depends on what the contract says and if he signed it. There is a possibility he will lose his $200.00

  • Yes he should have but this is a lesson learned for him. Have him call the office and ask for a copy. He may lose the $200 or he may just lose the portion that was for the application fee (if there was one.)

    No matter what apartment he rents from he will need renter's insurance. As far as trash and water, sometimes the landlord provides this and sometimes they don't. If they do provide it, it is included in the cost of the rent anyways, so no matter what these are things that he will have to pay for.

  • Yes, he should have gotten a copy, he also should have demanded a copy if one wasn't automatically handed to him. I am not sure where you live, but here we do not have to have renters insurance. Trash pickup is only in some communities, and we don't pay water here, only electricity/gas.

    I am sure he won't loose the $200, but I would go to the APT office ASAP and demand a copy of that paper work. In that it will state it is refundable or not.

  • He can go down and ask for a copy and bring it home for you to look at. Odds are he will be out the $200 unless they have something in the contract about being able to null the contract within so many days.

  • I'd leave this between your son and ex. Really, this is a very valuable learning lesson. Regardless of where he lives he'll need to budget in renter's insurance. It's cheap and incredibly important. Now, he's probably figured out that he needs to see what utilities are paid, what amenities are included, etc.

    And, unless the paperwork he signed was a lease, he'll get a portion of his money back I suspect. If, however, he signed a lease, he may be responsible for the total rent due if he breaks it. That'll be something you need to look in to
