Child support question.

Okay so my boyfriend/father of my son has another child and so obviously he pays child support. Well he also has to provide health care for him and pay 56% of the medical bills. Well on sunday his sons mother gave him a stack of receipts and said he has until march 1st to pay it (over 2,000 dollars) and I was looking at them and she has things like baby wipes,movies, gatorade,aveeno baby things, and random receipts from the pharmacy but yet she provided no proof that those things were for their son. And I thought that child support covered the baby wipes and things of that nature...so is she right to make him pay for those things when he is only supposed to be paying child support?

  • I would not consider those medical costs, maybe the pharmacy, ( if he has copys of the RX?) but the other stuff, no way. I would think medical costs would include things like meds, wheel chairs, dr. co pays special creams or whatever if he has skin conditions, NOT baby wipes. I would maybe phone around to see if a family practice lawyer can give you more info. (most will tell you stuff over the phone for free)

  • I'd take it to court from the pharmacy or not, he is supposed to cover part of the medicine he needs and copays not the other stuff

  • She is just the rudest person you could ever meet i swear it. She has no consideration of the facct that we have a child as well. She has seriously told him that he needs to give her his whole check before..I know he has to take care of his son but he pays 150 a week and pays 75 a week for health care and then pays 56% of medical expenses and then she just gives him receipt after receipt demanding more and more money while she is driving around in a brand new dodge caliber (with no job!!) she highlighted the gatorade and wrote -for dehydration- but yet everything else on the list was just regular things like toys and slim jims and random crap! I am just fed up with her and he just listens to whatever she says..I wish he would see that she is screwing him over!

  • Medical bills are for treatments and prescriptions, not over the counter meds,lotions, etc. Child support is meant to help with that stuff. For the medical treatments and prescriptions, check the state laws. Some allow for you to request copies of bills and receipts. Also, check the order to see if there is a time frame in there about payment. If not, check the state laws. I think it's usually 30 days to pay, but only within a certain time from when the cost was incurred (Example: The CP will have14 days from incurring the cost to send copies of the bills and receipt to the NCP, and the NCP will have 30 days to pay their portion of the bills).

  • I have looked through everything and there is no amount of days that he has to pay it by... She JUST gave him things from November.And there is no possible way that he can get 2,000 dollars together my march 1st.

  • laird, that depends, my court order says my ex is to pay 75% of all "medical needs' so I could charge him for over the counter meds, band aids but I don't because I don't want to waste my time but it just depends on what the CO says. OP, check the CO and see exactly what is says if it says 'co-pays' then it's only co pays from doctor's or dentist's visits and co pays from prescriptions, if it says "medical costs" it can be anything he needs to treat or prevent an illness and that does include gatorade (though I would never try to charge my ex for it). Are you sure she didn't want him to just pay for the medical stuff on the receipt? If there is no time frame then she can't really set a time he has to pay it by but she can take him to court if he doesn't pay in what she feels is a timely manner but IMO he should have a time frame put in the CO to prevent her from giving him all the receipts for the year at once or something.

    and also so he knows exactly how much time he has to pay her. If it's just copays, then he should pay her the co pays, if it's medical costs, he should go through the receipts and only pay for actual medical things (no toys or movies). Having said all of that, one thing you said bothered me:
    "She has no consideration of the facct that we have a child as well"
    She doesn't have to, your boyfriend chose to have another child she didn't, your child is not her concern so she has every right to demand what is ordered in the CO (though I agree, it seems she is asking for more) without any thought or consideration for your child

  • no.. he does not have to pay that - that is what child support is for - those things are not considered medical unless they are special medical wipes and lotion - then the receipt would clearly be from a pharmacy - he needs to tell her - that is what i paid you child support for ... i already paid this. manage your money better or i will be taking custody of the kid - if she cannot manage money - you dont want your ss going without because she is simply stupid.
