Can I get my daughter taken away

Can I get my daughter that is 8yrs old taken away from me by her father taking me to court over purely moving and switching schools too much?

I have a PP in place. I have the sole decisions making on schooling. I have had my daughter and always have had her 90% of the time. He gets her school breaks and summers.

can he win with the pure fact of consistency in one place.

  • I think he can get the court to look into it. When you say often do you mean once a year or several times ach year?

Consistancy is important to a child's education and developement. So too much can be veiwed as a bad thing.

  • I think the more important question is why are you moving so much and switching schools.. A judge might be interested in knowing that if he pushed the issue.

  • Actually, yes, they can if they deem her home unstable. Once a year moving is too much.

  • That isn't ideal as I am sure you know but if it is because of work and you move in the summer then I doubt any judge will intervene.
