ok its summer vac. fr the non custodial parent does the costoduial parent have any right to the child

  • I had a co-worker go through this. Her ex got the kids for the month of July and he would allow her to have no contact what so ever. He lived close by and throughout the year would get them every other weekend. It drove her crazy to not at least talk to her kids for the whole month. He said since she didn't have to pay child support for the month that he had them like he did for the rest of the year then she didn't have any right to them. The kids would come home and say they wanted to call but dad wouldn't let them. She may have no rights to them but that is not fair for the kids to let them talk to her at all for a month.

  • I'm guessing what you mean is that you do not have primary custody of your children and the summer is your legal time with them? If the court ruled that you get your child from July to August without any time in there with daddy, then no you have no legal obligation to have the kids see their dad. But if your kids miss their dad, I wouldn't have a problem with him picking them up for an afternoon here and there.
