Ok, my oldest dd new friend has a question for the divorced women.

she was living with her real father until three years ago and now she's living with her mom. they live in two different states and she hasn't heard from her father since he left state. her mother went and filed for child support, come to find out that her father was also claiming child support, her question is this:
who has a right to the money?
(they are living in an apartment and want to move into a house using that money)
and she's 14 if that helps.

  • Whoever has custody of the child gets the support payment. But if the court order says mom had to pay dad and mom didn't then even though the kid is living with mom mom owes money to dad. This is really an atty. Question that will probably require a court order.

  • Did they have a court order when they divorced? If not I would assume that the parent she is living with, though if she lived with her dad and her mom didn't pay any her mom might owe her dad.

  • depends on if there was a divorce decree that states who gets support. If they have gone to court and it has been awarded to a certain person, then that's who gets it until a motion has been put in to change it. A modification would have to be done if the mother is the one that is supposed to be paying out since her daughter is now living with her.

  • please do not tell me to myob this is not me asking she's asked me that question twice and i have no idea. i've never went through it so i don't know how to answer it. i've meet her mother and she's a nice lady working two jobs trying to make ends meet. that's the only reason i posted the question

  • i'm not sure. i know her dad was mad and took her to mich where him and his new wife lived, she had four kids of her own and the state stepped in and took the other kids just as she was leaving. her mom was able to take her so cs just let her. that's what she said, but at least you ladies are able to help her answer some questions her mother had. thanks.
