If a drunk driver hits a car and the driver is pregnant...........

and on her way to an abortion clinic, but the accident causes the baby to die instead, should the drunk driver still be charged with homicide?????????????? (The women still lives, just the baby dies)

  • According to the law that unborn child is not a life until it takes a breath. So no they wouldn't be charged.

  • What about the Lacey peterson case-not to get off topic-but wasn't she killed while pregnant and he was charged with both right?

  • but there are cases where people are charged with a double homicide when the baby is still in the belly.

    i think they should be charged with it.

    What if there was someone who had a few days left to live and they were killed? Does their life have no meaning?

    Until the pregnancy is terminated the baby is still alive.

    Hmmm, not sure. I doubt it though, unless they were able to prove that her baby took a breath before he was killed.

  • What about a fetus that COULD have survived outside the womb--like around 21 weeks? Or maybe the law will change if FOCA fully goes into effect--since it states that an abortion can take place at ANY time even into the 3rd trimester?!

  • Don't states already have laws that have to assist the infant in the case of an abortion that wasn't successful?
