My ex and I Just went to cs court last week(this is through my local dhs office) and i got for lack of a better term screwed. i make 10 an hr i work full time so my gross income is around 1600.00 a month may be a little more if i bonus from 12-20-11 to 4-16-12 there was over time avail at my job (over time is fairly rare ) so i worked a lot of it . my ex makes around 3600 gross a month including his allowances (bah and such )
this past Christmas my ex and i were talking about going back in and having our cs order modified since at the time of the last court date was laid off and he had quit his job ( his boss refused to give him a raise that he felt he earned ) so both of us were listed at making 1220.00 a month and the amount of support to be paid was 222.50 with us equaly splitting all out of pocket medical and child support expenses which i was ok
at the last court hearing after the judge thanked him for serving the only income that they would go off of was his basic pay of 1900.00 even though title 43 Oklahoma statute 118b subsection f list his allowances as pay.
but they had no qualms about including my overtime(they have my gross at 2900 +)
so our split went from being 50-50
to 61(me) -39 (him )
and support to be paid to 260.00
the whole reason we even talked about going to cs was for the medical support amount to be changed where he is covering the largest part (at least that was what we had agreed to)
a little background info ex joined the military 6 months after our last order
he does have a wife to support
no I'm not money hungry i have a son with special needs
my ex was very happy at the way things turned out and his wife actually said that that they new it would turn out that way
i just need advised i want to file an appeal my self since oi don't have an atty but i have to prove that his bah was listed on his check stub since they are saying it wasn't (i saw it it was 909)
how can i get a generic army pay stub that shows how his bah and other allowances were listed
