  • My dh lived with his mom passed 18 and he filed taxes and she claimed him as a dependent. He has to file his taxes unless you claimed his income. When he files he just checks the box where it says did someone claim you as a dependent.

  • i dont think he can file if you claimed him.... i think he has to file if he made a certain amount of money in 08.

  • Yep. You can still claim him because you provide over 50% of his living expenses. He also needs to file his taxes. It will not affect yours. I do Drew's at turbotax online for free and a small fee to do his state. They will direct deposit his refunds into his account and it doesn't change anything on ours. Hope that helps.

  • There are several options. If he has earned income then he needs to file. IF it's a W-2, he can probably file a 1040 ez, he just won't have any exemptions b/c you get it for claiming him. I'd recommend having him file b/c then he can get back any withholding. Just look up the kiddie tax online. he may be requried to file at *your* tax rate. Technically, if you are providing more than half of his income, he will still be subject to the kiddie tax. If he only has interest income, then it can be added to your return. If there's no substantial income and no withholding, no need for him to file at all.

  • Kiddie tax has got to be one of the biggest jokes. The idea was to tax income that people has put into their kids accounts to avoid taxes. But instead it ends up affecting all sorts of people who don't even know it.
