Do you have to file for child support?

If you are on medicaid, do you have to file for child support on the father just because the office referred it to the attorney general office. Shouldn't that be going through our lawyers when we go through the divorce?

  • no because medicaid is holding the father responsible since they are insuring you. They are filing for themselves because a cut of the CS will go to them.

  • When you file for aid through social services they automatically REQUIRE you to open a child support claim with their offices. Its the same offices the judge will likely use to set it anyway. The state is insuring there is a case against the father and they are able to collect asap. They insure you get money for your kids and any moneys you got from the state are repaid by the absent parent. It wont affect your divorce at all.

  • In Ohio you only have to file for child support if you are receiving monetary assistance, i.e. a welfare check or food stamps. If you are only receiving child care vouchers or Medicaid, it is not a requirement.

  • Usually if you are applying for services they want your child support to go through your state's office of child support.

    No, because we havn't had our first court date for anything to be decided yet. Now if that is the case after that , i don't know yet. We will have to wait and see.
