Ex spanking our 4yr old and leaving bruises

I called my attorney today to see what i Should do about my ex spanking our 4 yr old son and leaving bruises on his bottom. In our court papers it says no excessive corporal punishment. He spanked our son a year ago and left marks as well which i documented. She says to wait to see if he spanks him a third time because then it shows a pattern and is for sure child abuse. I am tired of my kid getting spanked for stupid things i asked my ex what happened because my son told me dad spanked him for saying something bad. My ex told me a diff story. I can understand a slight tap on the bottom but hard enough to leave a bruise is abuse in my eyes. I dont hit my children when they dont listen they simply go sit in the corner. I dont know what to do because I know if i call DCFS it will make things even worse. But i dont want to wait to see if he gets hurt again. I'm really confused

  • Call the police. Your attorney is, in my opinion, giving you horrible advice. If you spank a child hard enough to leave bruises TWICE that's enough to prove child abuse for me.

    Make a police report, document the evidence and ask for an emergency CO disallowing him to see his son until this crap is taken care of

  • leaving marks, even only 1 time, is abuse. do not wait for it to happen again, it is already abuse! take pictures now. you can turn him in yourself to cps, just have the documentation!

  • Im just so scared my heart feels like it will jump out of my chest. I dont have residential custody of our son because my dad was dying when our divorce was going on and i needed to take care of him and my ex had a better attorney. I'm just scared because i dont know how this will play out with me not having the residential custody.

  • report, file charges for child abuse, and document. Get the visitation suspended until this is resolved.

  • um, its your child ! you have to step up to the plate and protect him. If hes at your place call the cops end of story, if you dont and it continues and you did nothing then you are as much to blame for every hit he endures.
