Does anyone know if a creditor can take your tax return without you knowing?

  • they will generally send you notice. But if you have already filed your taxes you can go to 'where's my refund" on the IRS website and if they have processed your return it will have a note on the bottom if it is being garnished to pay of a collection

  • Depends on the creditor. Federal student loans or government credit cards, yes they can. They took ours 2 years in a row for a debt on my dh's military AAFES credit card. No lawsuit needed. Your average everyday collector, no. Not without suing you first.
