how long does custody take if they can not find the father?

  • If they can't find the father then why are you fighting for custody? Don't you already have it?

  • I think it depends on the state. In some states you have to wait three months and place a public notification in the newspaper to advise him there is a custody proceeding pending. In other states you can petition the court for custody and if he doesn't show up in court, you get it automatically. Try calling your local courthouse and asking them what your best course of action is. Often they have a free advocate who can answer questions specific to your state.

  • I think she is referring to a severing of the father's parental rights so that he cannot have access ,either for adoption by a new spouse or for the child's well being.
    And they can run it in the paper in most states for like 90 days or something and if he does not respond,he loses all his rights.
