In kentucky if my x added his new wife and kids to insurance and premiums went up will his child support be lowered

  • How long has it been that you have asked for an increase in support? If he has payroll deductions, they do it off of the gross pay, not the net, so it shouldn't.

  • havent asked for increase and 1 of my children just turned 19 so he is going to request a deduction based on that and the insurance increase.

  • Well, how long is he supposed to pay, until they are 21 or 18? I would say ask for an increase right now, cost of living etc. unless he is no longer liable for the 19 year old.

  • Laws vary from state to state. Usually support is based on income. They don't care what your expenses are. So unless his actual income is changing, he may not be successful in getting it lowered. Your best bet is to talk to a lawyer in your area. A consult can be free or at low cost.

  • he is suppose to pay til 18. but we have other children too. i dont mind it going down because of my sone being 19 but i was just curious if they can lower it bc of the insurance increase as well.even with his new wife on the policy

  • how many kids? Most states have a chart for child support, like 25% for one 30% for 2, and so on, google it and see what you find out.
