Why do lawyers seek mistrials??

I am watching the Jodi Arias trial. Her attorneys are seeking a mistrial. I just never understood why attorneys do this?? They would have to do this all over again. I just DONT get it.

  • the lawyers that are calling mistrials the the one's losing so they are finding any tactic to drag things on or give them more time to find a new argument.

  • They get paid by the hour and the court time?
If it looks like it is not going to go their way a mistrial starts them over fresh.

  • Grounds for appeal if they lose. Also, if they do get the mistrial, it's not guaranteed the state will re-try the case.

  • Mistrials are supposed to be sought if there was an error that prevented someone from getting his or her fair day in court. As often as not, lawyers will seek a mistrial when the arguments aren't going in their favor.
