1 Bump

Is it against law to have a 15 yr old boy babysit his 15 month old brother at midnight while mom goes to get stepdad, when said 15 yr old needs to get up for school next day?

Then gets on to son for being grumpy and says phone needs to be on counter by 9 pm on school night. What is difference in staying up to tend to 15 month old infant or having phone?

  • Unwise and inconsiderate, yes, but probably not illegal.

  • Where is Mom going to get the step dad at? From work? Out partying? Pickup at the airport?
Wherever she is going its best to take the baby with her or have him arrange for a ride home at that hour.

  • I would think a 15 month old would be asleep at that time. Anyway I'm not sure that would be illegal.

  • Depends on the state/local laws but in my state, no it is not illegal.

  • I would think a 15 year old could be responsible for babysitting any child. A baby monitor in the teens room would wake him up if he needed to be in bed. sleeping for school.

  • Is he laying down while the 15 month old is sleeping also?
How long are the parents gone long?
No it is not against the law I babysat at 15 for other people on school nights.
It is a little unfair to be upset because he is a little grumpy because he was up late on your behalf, however.

  • If both are sleeping, and the baby monitor is in the teens room, and you're only gone a short time, it's really no different than if mom or dad were home sleeping with the baby monitor next to them.

But as far as the legality of it, you could probably find out easily by either doing an internet search of your question, or calling your local police department.

  • BTW- are you the 15 year old boy?

Answer by PartyGalAnne at 10:52 PM on Jun. 4, 2013

  • No it's not illegal. It may "suck" but so do a lot of things.

  • its legal, i did it (tho i got paid). and yeah its an asshole move to be mad at someone for getting less sleep, when they got less sleep b/c they were doing something for someone. granted, most 15 month olds get enough sleep that the 15 year old could have gone to bed and everything been a-ok.
