I still see people who still want to make new gun control laws. Well I found something....its also a spin off of NP's post earlier.

Federal law statute § 924(C) IF,DURING AND IN RELATION TO A CRIME OF VIOLENCE OR DRUG TRAFFICKING CRIME, A PERSON USES OR CARRIES A FIREARM, THE SENTENCES FOR THE GUN ARE:

Gun possession  

1st Offense 

If a gun is possessed....5 yr MM

Or if it is

     a)  A gun that is a short barreled rifle or shotgun....10 yr MM

      b)  If it is a machine gun, destructive device or a silencer is used....30 MM

2nd offense and/or more...

      a)  For the short barreled rifle or shotgun...25yr MM

      b)  Machine gun, or destructive device or silencer.....Life without parole.

Brandishing

1st Offense

If a gun is brandished...displayed or suggesting the presence of a gun to intimidate... 7 yr MM

Or if it is...

   **a)  10 yr MM

   **b)  30 yr MM

2nd offense...

   The brandishing of a gun is 25 yr MM

Or if it is...

     **a) 25 yr MM

     **b) Life

If a gun is discharged, its a 10 yr MM and 2nd time or more is 25 yr MM

Or if it is

1st Offense

   **a) 10 yr MM

    **b) 30 yr MM

2nd Offense

   a) 25 yr MM

   b) Life

Here is an example..

  Offender deals pot 3x in 1 week, each time he carries a gun with him. He will be convicted of 3 counts of drug trafficking and 3 counts of § 924(C)

His sentence will be 5 yrs for drug trafficking + 5 yrs 1st offense § 924(C)

2nd time offense § 924(C) will be 25+  

 Anytime after that he can be convicted +25 yrs  For a grand total of 60 yrs!!

 

**The “a” and “b” like above is just repeating what I typed and do not feel like re-typing them again! And "MM" is mandatory minimum

Does this make sense?? Why do folks want new gun laws, when the gun laws as it stands today, are strict enough now?? We only need out govt to enforce these already in place?? 

Do you think these are strict enough? Or do we need more?

  • If the laws you described could be strictly enforced, I think they'd be enough. But too often, overcrowded prisons and bargaining about what charges are filed take the teeth out of existing laws.

  • Because creating new restrictive gun laws is more politically advantageous than doing the work to enforce current laws. I mean, how else will they make us feel paranoid and unsafe if they aren't actively acting like they will do the work to keep us safe? It seems to work really well for Chicago.

  • I think we've proven here before, just by asking people who advocate for tougher gun laws what the laws already said, that nobody who wants "tougher laws" has ever bothered to read the ones already there.
