Oklahoma stops all National Guard spousal benefits rather than comply with DoD orders

http://www.tulsaworld.com/news/government/fallin-halts-all-spouse-benefit-applications-at-state-owned-national/article_1511406c-67e1-5b15-94ba-cfe887c15bac.html?mode=story

Sadly, some of the first comments on the article are cheering her on for it.  Those state facilities are paid for with FEDERAL funds - should Oklahoma lose all of its federal funding since it refused to comply with federal directives?

  • I thought Federal trumped State, but regardless...shame on her bigoted ass!
I bet she'd like the LBGT Military protecting her ass should the need arise!

Lose their Federal funding, if that's what it takes to wake her up!

  • I don't think they should block federal funding because it will only further hurt military personnel. They should arrest her for violation of federal law, though.

id hate to loose Federal funding, but it might wake up the ignorant rednecks who voted her useless dumb ass into office.

Again, the federal govt has no say on what the STATE RUN National Guard can do or not do. OK governor said ..." National Guard facilities and employees funded with state dollars will not process benefits for married, same-sex couples...." So if the NG base is state funded, no federal funding at all, there is absolutely nothing the fed govt can say or do about it. I am NOT saying what she did was right, no she is a bitch and a bigoted one at that, but unfortunately nobody can do anything, she has the law on her side.

  • Again, the federal govt has no say on what the STATE RUN National Guard can do or not do.

Yes, they do - that National Guard is federally funded, just like Medicaid. The state administers it, but the federal government funds it and issues directives on how it's run. The two are generally tied together. If she refuses to follow a direct order from the DoD, her federal funding needs to be pulled.

"The federal government provides about 90 percent of the budget for the Oklahoma Military Department, which includes the National Guard." so yeah its funded Federally. Oklahoma is notorious for not wanting any state to ever get any federal dollars, but raking it every last federal dime.

    NO IT DOES NOT.. ..

."Federal Law provides the Governor with the ability to place a soldier in a full-time duty status under the command and control of the State but directly funded with Federal dollars. Even though this duty status is authorized by Federal statute, this section is a statutory exception to the Posse Comitatus Act; the Governor may use the Guard in a law enforcement capacity; and the chain of command rests within the State...."

  • The Posse Comitatus Act refers to the Armed Forces of the United States. It does not apply to the National Guard under state authority from acting in a law enforcement capacity within its home state or in an adjacent state if invited by that state's governor.

Another words, while it maybe getting federal funding, the fed govt has NO control on how a governor operates/runs their NG. The only time the NG will be under federal control is if Obama declares a national emergency and calls on the NG to defend against a foreign or domestic enemy.
