Laws on fetal abuse?

Does anyone know if there are laws protecting an unborn baby from a mother's abuse (alcohol use, drugs, etc. while pregnant). If so, how can you report it if you know something??? Any responses welcome!

  • it really depends on the state. No state can drug test a pregnant mother without her consent, unless they changed it, so I don't think anon is right in that matter.

    If you suspect drug abuse you could notify someone, and ask, such as CPS or something, and they may make a visit, and require drug testing of the child, or mother. It all depends on the state etc.

    As for the murder thing, I am pretty sure you now get charged with double murder if you murder a pregnant women and her fetus was viable...

  • no. what will happen is they will drug test the baby when baby is born and then take it away if there's drugs in the system

  • no there isnt sad to say you can even kill a mother who is pregnant and only be held accountable for her because in the courts the baby is not a baby til they take their first brethe outside the womb

  • wow i do know that here in Michigan when i woman goes to the dr they can and will test the mother for drugs and if they show up positive they have a bunch of stuff they have to do such as home visits and more drug tests

  • Unfortunately, no, a woman has the "right" to poison her baby inutero if she so wishes. That is considered "her choice", irresponsible as it is. If she really doesn't care, try to convince her to abort now but if she's so far along there is really no way to stop her until the baby is born and the pediatrician does a drug test on the first bowel movement. If it is positive then DHS or CCp can step in. In some way she will have to let the doctor or nurses know she used during pregnancy and when the last time she used was. I'm so sorry :(
