Does NYS backdate child support?

Like I know some states if you've never had a child support order they will go back to when the child was born. Does NY do that? I heard no but wasn't sure.

  • You would have to check with the state's laws through your local child support agency. I don't know if the judge has to specifically put it into the support order or if it is a state regulation that is done automatically.
In VA it is not done unless the judge specifies it in the support order.
