Can a grandparent take away your parental rights just because they believe u are uncapable of taking care of a child? with no proof of violence, neglect etc???

  • with no proof, and no history of caring for the kids as their primary home, no way. they could get csb to check you but they cant get teh kids..

  • They need proof of violence neglect or the all encompassing "best interests of the child" statue that gives judges the ability to do whatever they want really.

    Like if you move every 8 months because you can't keep a job - they may let the kid stay with grandma instead. This isn't neglect exactly but it's instability for the kids.

    They will look to the Dad before they look to grandma though.

  • No, a grandparent cannot take away your rights. They can file a report with child protective services, and then that agency may investigate. Child protective services can remove a child from the home if they see signs of neglect or abuse. If this happens, the goal is ALWAYS to reunite the mother and child. You would only not get your child back if you didn't do what they asked you to do (usually stuff like stay sober, go to treatment if you need it, go to some parenting classes etc.)

  • They can't take away anything. They'd have to take you to court and proove what they are saying. A judge isn't going to take anyones word without some kind of evidence!

  • No, they would have to report it to CPS and then it would have to be investigated and it all has to be done legally. If the grandparents just take the child, that is kidnapping and they will go to jail.

  • No, they would have to proof that you are a unfit mother. You have to watch your step. If they want the kids they can make it hard for you.

  • They can try. If they feel there is a problem, they sure as hell can try. To succeed they have to have proof.

  • No. and just to throw is out there, if anyone tried to take my baby I'd run so fast and so far they would never find him to remove him from my care.
