Medical negligence?

My daughter's 4 mths old. I took her to doctor for 4 months check up on 4/16. When we got in, nurse checked the rectal temperature but the thermometer wasn't reading, nurse pulled out the prode. Immediately, I noticed that the prode cover was missing I asked where is the cover? Then she called doctor to take a look but they didn't find the cover. My baby rectal was bleeding. Doctor sent my baby to ER they took x-ray but didn't see it, they said p/s because of the clear plastic. They sent us to ChildrenHospital. Took another x-ray, didn't see nothing, then the Ultrasound, see somthing but not sure. Doctors used pinky finger to feel it but didn't feel not thing. Then they sent to CT scan, see somthing in the lower rectum but not sure what is it. We was stay over nite for next exam, conlonscoping in the morning. Result, there was nothing. Doctor said p/s nurse didn't put the cover. What would you do if it happen to your baby?

  • Maybe call and talk to an attorney? Is she having problems since then? I hope everything works out and that she's ok.

  • ....sorry i dont know if I fully understood it all but as far as I could put it all together...it was because the nurse didnt use the thermometer cover?!? You should have kicked her @$$ and never let it happen....lesson learned I suppose...!?

  • You seriously want to sue someone for a failure to put the cover on the thermometer? Do you have any idea how much it's going to cost to litigate?

  • Find a new pediatrician or if you like your ped, complain about the nurse. Have the doctor's office pay your medical bills. If they refuse, then sue. But don't sue expecting to make a profit

  • It's really hard to sue and get anything from it. My husbands grandma died of MRSA due to the dr that performed her surgery forgetting to take off his watch. It was in the medical report. The kids tried to take it to court and nothing happend. I dont think this will go very far if you are wanting to take legal action. I would do as a previous post says and find a pediatrician. Good Luck!

  • I think its ridiculous that you are going to sue (or thinking about it) over YOU being negligent as well...yeah the nurse screwed up and I am sorry if this sounds mean I do not mean it to be, but you seen that the nurse was about to do it without a cover. Why did you let her continue? Get a new pediatrician because he should have told the nurse right then and there she screwed up. And he should have never sent you off to do all that stuff...the cover just hurt her bottom. Hope she feels better hun...
