restraining order

Can an only son get a restraining against his fathers ex-wife if the father is in the hospital and in a coma? The ex wife is not suppose to be allowed to see him at all . But she went over there Sunday and lied to the person who was suppose to be there for the family and only letting family in. Anyways the ex-wife lied to the person adn told her that her and the son had worked things out and she would go in and see him. That is not true and i was going to tel lhim to try to get a restraining order against her but i don't know if he can really do it or not.Anyone know?

  • if shes not suppost to be with him them I think he can, is there a saftey reason shes not allowed seeing him?

  • It depends on what state youre in. Every state has different laws regarding restraining orders (or we call them injunctions for protection here in FL). Is there already a restraining order in place? If so then she can be violated on that restraining order. If not, at least in the state of florida, he can file, but it's up to the judge on whether the injunction is granted or not. Usually you have to have proof of why the restraining order is needed to be in place. Also, I'm assuming they would need a power of attorney from whom ever is filling the petition. Hope this helps some. :)
