If a mother has restraining order against her kids father cuz of abuse should he still have to pay child support?

My Bff has a restraining order on the father of her 3 kids cuz he was physcially abusive to her.. he is refusing to pay child support cuz he cant see his kids (not that he saw them much to begin with) should he have to pay?

  • Yes. There is no clause in the restarining order that gets him out of paying child support. He can take it to the child support agency and they will get the money to her or he can mail it to her. I love it when men think like that.

  • Whether he sees them or not doesn't change the fact that they EXIST, so yes he still has to pay child support. Take him to court if he doesn't!

  • It depends on what the court says, not her, not him.

    If the court has ordered the payment of child support then he still has to pay. If there is no court order, she can't force him to pay it.

  • The two things are completely unrelated. He can try to with hold CS payments but, it will catch up with him eventually. Just wait til they start garmishing his paychecks.

  • Yes, he still has to pay child support. She needs to see the proper authorities on this subject in the area.
