Can I have my daughter go by my last name in school?

My ex is telling me that what im doing is illegal, but I have had several friends who have done the same thing. My ex is a druggy, he chose not to be around my daughter until recently, he just found out that when my daughter does sports and in school she uses my last name vs his. The most interesting part is that his last name isnt legally his last name, its his step dads last name, his mother chose to use that vs his bio fathers last name.

  • as a teacher, all of my students have used their LEGAL last names. Don't know if that helps at all.

  • My mom's best friend's daughter did the same. She always went by her mom's last name for everything, she was disappointed when she had to put her legal last name on her graduation invites, since that's what would be on her diploma.

  • I would think she would have to use her legal name. Whatever is on her birth certificate & SS card is what she should use. I just think using a different last name will cause a lot of confusion down the road -- driver's license, student records, diploma, credit issues, background checks for jobs, etc.

    If he's such a deadbeat, petition to have his rights stripped & her name legally changed.

  • well my sis's little girl uses a hyphnated name that way she can use which ever one she wants
