if kids are the same age can they get locked up for haveing sex?

my friend said that if a girl and boy who are the same age have sex the guy can get locked up. both of the kids or under 18. i never heard that i only heard if the guy is over 18 and the girl is under 18 then the guy can get locked up. so is this true can a guy have sex with a girl his age(both are under the age of 18) and get locked up for it.

  • Not typically. It IS, in most states, illegal. ...but chances are they are not going to go to juvinelle facility.

  • I've only ever heard of it in the case that there is a 3 or 5 year age difference between the minors (depends on the state). Then it can be statutory rape. They can't make SEX illegal, but they can define age limits.

  • There also have been cases where just sending suggestive pictures and such can get both recipients sent to jail, even if they were the same age and both underage. I think that it all depends on whether the girl's family presses charges or not, honestly.

  • no its not illegal even if one was 16 and the other was 18 they wouldnt do anything about it or 17 and 19 because its a 2 year limitation now if its like 16 and 20 then they can face some serious trouble

  • And actually I've read before that its a 4 years age difference not 2 years, Down to 16.
