question about divorce

if two people were married for a little over a year and they had no type of relationship basically living separete lives when they divorce the women wants to get money from her husband and is going to say he cheated.. when he didnt can he just deny it how can he prove its not true. and what will happen

  • She cannot just "say" he cheated....she has to be able to prove that he cheated. Courts don't just take your word for things like that, especially in divorce and child custody issues.

  • no need to accuse him of anything. Divorce is now Dissolution of Marriage which means you don't have to blame someone for the marriage going bad like you did when there were Divorces. Just claim Irreconcilable differences. So let her accuse him all she wants, it won't do her any good and she can't get money bc they were not married long enough. No spousal support for her. She can get child support if there was a child but there is a calculator for that. She doesn't choose the amount. So if there are no children she just packs her bags and says goodbye even if he did cheat.

  • Cheating is irrelevant. It doesn't matter. Check with your state laws. If they do Dissolution of Marriages then she's out of luck. Tell her to go home to mom and cry to her bc it doesn't matter if he cheated. It just means he doesn't like her anymore and needs to move on. She can cry cheater all the way home but it will do no good.

  • Depends on a lot of different things.

    Is she talking about alimony? Most states won't give alimony unless they've been married for several years.

    And if she has a child with this man, child support is determined by a formula.

  • she should have been a better wife. She can't punish him by taking his money for finding someone else! She has to be stupid to think she can. This is 2009. They can't do that anymore. She's been watching too many soap operas to think she can! LOL

  • Most of the time saying he cheated won't do her any good at all. Most states are no fault states.
