child support hearing

what can i expect at a child support hearing case the father has been paying child support directly to me but they said i had to take him to court to keep insurance since both me and my daughter are both on medicaid has anyone else been through this???

  • THEY DONT SCHEDULE VISITATION THERE VISITATION AND CHILD SUPPORT ARE TWO DIFFERENT THINGS THE ONLY THING THEY ASK ABOUT VISITATION IS HOW OFTEN THE CHILD IS WITH THE FATHER AND THAT DESIGNATES THE AMOUNTS. BUT THAT'S ABOUT IT. IF HE WANTS TO TAKE YOU UP ON VISITATION HE HAS TO FILE THE PAPERS FOR THAT. CHILD SUPPORT DOESNT SET THAT UP.

  • In Michigan, all they do is ask for your salary and how many hours you work, plus how often you get paid. Then they ask the father the exact same questions... then they plug it into a standard formula and the answer to the equation is what he pays... nothing else comes into play, just the factual numbers and the equation... and if you don't have paperwork with you to back up your statements (like pay stubs) they give you 7 days to mail them in, or they assign you what they think is a realistic salary... (usually its minimum wage for your state at 40 hours per week) and they use that number for the formula... if you or the father is currently unemployed, then the state figures your salary at minimum wage at 20 hours per week, because in the courts eyes everyone can at least get a job at mcdonalds part time to help support their children. Like i said this goes for Michigan, but I'm sure most states have a similar set up

  • Ditto firt poster. Take your tax returns. My ex conviniently forgot his and has prolonged the case for 3 months!
