child support question

what if somone get a dna test done and is the father but has no job. but the mother works but needs the help from the father also. would would be done in this situation?

  • The courts can order him to get a job and support his child. However, he can run, hide, and work under the table.

  • The courts will still rule some kind of minimum support and if dad doesn't pay it, it will go into arrears. The court can at some point issue sanctions for non-payment.

    It doesn't work that way.
    The minimum child support payment is set based on the minimum wage pay. If unemployed the court will calculate the father's child support rate based on that states minimum wage, add your income, and find the support amount for one child based on your combined income. Then it will determine what percentage he earns (or should be earning) and what percentage you earn. He will then be responsible for payments based on his percentage.

  • When my ex wasn't working and we went to court to establish child support, they based his child support payment on what minimum wage was in our state at the time. He was told to pay that amount, and that if he didn't have a job, he better get one.
