Does it matter if I file for divorce or wait for him to file?

  • In a lot of states it actually makes a difference who files first. Do you have children? It is in your better interest to file first if you have kids, that way you can get everything about the children in order, ie that they stay with you, you have temporary custody and such. You dont want to wait for him to file then find out that he gets the kids or something like that, and I know it does happen, so if for no other reason than the children, YES, go file first

  • go file first. there will be temporary orders for kids, marital property (homes, cars, utilities, etc) and you need to file them all together. Go first thing in the morning. The local women's center can help you find free and cheap legal help. The clerk of court can give you the info or you can call your local police dept and get the number.
