School question......

ok, so my daughter is in 8th grade and she is in special ed( Because when she was in elementry sometimes she needed to be pulled out when she did not get something) and when she went to middle school they said they did not have extra help for her (and this is a rich school) so they put her in special ed,and she does not belong there and i told them i want her out and they refused to take her out of this classroom..also my daughter HATES being in the classroom she is depressed from it and she is not with her friends at all and she has NOT learned anything or get the "help" she needed from being there and there is nothing but Boys in there with mental i have got an attorny and i am looking to sue the school for causing nothing but hell for me and my daughter and my question is should i pull my daughter out of the school and homeschool her,while i am sueing the school?? i dont know what to do..Thankss!!!

  • This doesn't make sense. The cost of keeping a child in special ed usually causes a situation where children who need it don't get it. Have you requested that she get tested for learning problems? If she tests "normal," they should put her with the "normal" children.

    It sounds like you are fed up though. Do you have the materials and time for home school? It can be very rewarding for some families.

    Also, if you are engaged in a law suit, I would hate to think that teachers might treat her differently. Since they are already disrespecting your wishes and tormenting her by holding her hostage in the special needs class, the strain of a law suit is not something you want transferred to her.

  • There should be some type of testing or evaluation to justify putting her in special education classes. When kids go to middle school, it's harder because they are either expected to blend in to the typical population or go into special ed services - they generally don't have the built in supports that most elementary schools have.
    So are you saying that you think she could function in regular classes? If not, why not just pull her out of the special class and put her in with the typical kids and have like a "resource" class for her elective?
    She should be able to be mainstreamed at least part of the day, for PE and/or lunch. Is she not EVER with her friends?
    If she's not getting what she needs, please don't leave her there!
