What's the first step to getting a divorce?

My husband and I have decided to get a divorce... What now???

  • Call an attorney and get it started. Make out a parenting plan while you want for the appt. If you agree on everything you can use one attorney. If not, you both get one. If you don't have children together or own real estate you may be able to go to the courthouse and get the paperwork to do it yourself.

  • One of you needs to move out. Then you need to get lawers. It would be good if you two could nicely decide on custody of the children if ythere are any and split your stuff yourselves.

  • I agree with the first poster... You need to contact an attorney so that he/she can get the custody papers/parenting plan etc... together...
    Now in some states with children once you file there is a 6 months waiting period during this time is when most often (if there are children) the child support case is opened, parenting plans are made, etc....

  • 1) attorney 2) physical separation 3) preliminary hearing (decree of separate maintenance, child support, custody, etc. are addressed) 4) divorce hearing (finalization of all matters- may take between 3 months to 1 year from physical separation to achieve the divorce... and you may wind up going to trial, depending on your circumstances. could wind up going to court 3 or more times)
