what happens when child support recovery puts leins on personal property?

do they loose their house and car when that happens? or is it like taking out a forced loan they have to pay back in x amount of months then they loose the property? can someone explain this to me?

  • A lein is placed so when the house or vehicle is sold, the person who is owed the money gets it before the property owner gets their money. The child support agency or family courts would get the money and then it would be forwarded to the person who the support is owed too.

  • Property liens usually just mean they cannot sell the property without paying off the lien in the course of the sale.

  • Exactly. When the property is sold, the proceeds go to pay off the lien.

  • Mama would get the money for back child support if the personal property and/or house is sold.

  • If the lien comes from the child support agency the money gets paid to the agency and the agency gives it to the mama or daddy depending on who has custody of the child(ren).

  • if you have a lien on someones property then if they sell their house or car or any form of personal property what ever money comes out of it is yours until the balance of back child support or child support is paid
