If there is a child support order for my step kids biomom to pay child support and her husband has to pay on his other kids will we get any of their Tax return if she has not paid in like a year?

Bm owes a lot of back support but her Husband owes more for his kids and has had his license taken away at one point, She told us she would have her husband file injured spouse so we would not get anything so would all the taxes go to his children do they split it can they both file injured spouse? I dnt care if there income taxes go to his kids they prolly need it more I was just wondering. She also said she would quit her job (she got fired) so she did not hae to pay I think it is rediculus as she is a very bad influence on the kids she is married and has several boyfriends and she borrows her kids money all the time and never gives it back and she is just rude. (she even makes fun of the kids) but she also thinks she knows all the tax laws yadda yadda!

  • YOU SHOULD GET THE TAX RETURN AS LONG AS ITS COURT ORDERED. CHILD SUPPORT IN MOST STATES CAN CEASE THE RETURN BUT TO MAKE SURE YOUR STATE DOES THIS JUST CALL YOUR LOCAL JOBS AND FAMILY SERVICE DEPARTMENT. GOOD LUCK

  • it is court ordered that she pay and we have it through Support Enforcement and she now has a lien on her properties such as vehicles etc, but does the court order have to say she will have to pay her tax return if she has back support or whatever???

  • Yes a court order has to state where they can take the money from. You dont just magically get it fromher tax return ( that is if she gets one)

    Try going to child support enforcement .
    This si an issue your husband needs to deal with. I do NOT mean to sound rude but it isnt your place.

  • the division of support enforcement can with hold irs tax refunds but I doint know about the injured spouse thing anybody?

  • Filing injured spouse they look at what percent of any joint refund is due to her income and what percent is due to his. You need to see about taking this deadbeat to court to get what you're owed. A judgment against her would be your best bet.
