child support

ok so i have 2 kids and one on the way and when i was 8 weeks preg i found out my hubby was cheating in the state we live in they wont let us get a devorce till i have the baby which is in july my ? is if i move out now will they start child support now or do i have to wait till the devorce i want out now so bad he is makeing my life miserable he dosent come home sometimes for days at a time when he dose he dosent hlp with our kids but if they dont start the child support i cant move out b/c i am a stay at home mom so i have no money thank you

  • they can establish custody and start child support before you divorce, but it may be a couple of months before they get everything straightened out and even then there is no guarantee that he will pay (unless you go through child support enforcement and he has a job so they can just garnish his wages). can you clean out the bank account when you leave to hold you until the papers are drawn up?

  • Long before my divorce, I established custody of my son and was able to go for child support... but it can be a lenghty process, I would start now. It will make the divorce go quicker when too once you are able to proceed with that. Go to welfare, they will direct you if you don't know what to do, where to start if you don't have any money.
    Get out of that house you don't need to be living in that stressful environment in your situation, what a creep. :(

  • call social services in your town and there is a form you can fill out if you're married and seeking child support. you can get other things like food stamps and medicaid there too. you can't live with the person usually (if they check), you have to be separated. but bc of your situation they will make sure he pays child suport even before the divorce is final. you can also get help with the divorce in some states, here it's called legal wont be able to get child support for your infant until after it's born and paternity is established.

  • thank you ladies i also had another ? ok i know when we go he will get visitation and thats fine i want him to see his kids but i dont want him haveing them overnight and i dont want them around certain people i will explain..... for example he wont wake up i have to yell at him 10 times to get him to help and that was when i was on bedrest so i know if hes home with them by himself he wont get up with them..... i went to the dr the other day it was at 8am -11am when i got home he still had not got them a drink they didnt have there daipers changed or breakfast and now it was lunch time i felt so bad about the poeple thing he told me if we split up he will take thema round everyone i dont aprove of what can i do

  • You can request that the judge order that certain people not be allowed near the children, but that will usually only get approved if you have proof of them being dangerous to the children. Also, without proof of him being unable/unwilling to care for the children, you may not be able to stop overnight visits.

    As for the child support, you can file with the courts to establish it for your two children. You can't get any for the unborn child until he/she is born. However, you can ask for a provision to be put into the order that once the child is born, support will increase to *insert state mandated amount*.

  • thank you again to everyone so i have proof on the people that i dont want them around and what can i do to prove so my hubby cant get them overnight till they are older i have doc. everything do i need to take pics or something
