do babies count in the carpool lane?

i have a long commute through san diego, and i've been taking the carpool lane with my six month old... is this legal??

  • Good question! Baby is a person right? But I am sure there are laws that don't include infants. Maybe try the DMV.

  • yeah, im pretty sure. I moved to SD two years ago, and i remember in the permit exam there being a question where the trick answer was to say 'NO' to this instance being legal, when in fact it IS perfectly legal. I guess i could be mistaken though.. plead dumb if you get pulled over.

  • Yes it is legal at least in arizona and california where i have actually used a carpool lane lol. two people is two people no matter the age. You may have a officer drive up alongside you and look in to see if there is a small person with you, i have had that happen to me and they just smiled waved and went on their way.

  • Actually, only DRIVERS count as carpool. Children under sixteen would not be driving anyway so you can get a ticket for using the carpool lane counting on kids as passengers. I have the ticket to prove it. :(
