Bankruptcy and tax returns

I filled for bankruptcy today and was told by my lawyer that they exempted more than I recieved last year on my tax return for this year so we were okay to file. I filled the return and between the federal and state we are actually receiving $1000 more than they exempted.

1. Will the trustee take the difference?
2. Will the tax return be taken until the BK is complete?
3. Has anyone had the trustee take the return even though part is exempted?

  • We did a chapter 7 several years ago, but taxes and tax returns were not something our lawyer even talked about. We filed in the month of October though.
