can you give your kid the fathers last name if he is not there to sign the birth certificet?

    like some people even make up a name -- a mix of each of their last names....

  • The father doesnt have to sign anything if he is married to you...if he is not married to you he has to sign an affidavit that is notarized saying he is the father or you can not legally list him as the father. As for the last name, I do believe you can use any last name you wish as long as you arent doing it with the intention to defraud. An example would be you use the last name "Pitt" because you want to claim the baby's daddy is Brad Pitt. Which might sound silly but its happened.
