What would you do if your adult child was taking care of your bills and???

You find out that she has been shopping with your credit cards and has run up a total of 45K in debt. Some shopping many late charges and interest she even charged a trip to Mexico for her entire family on moms card. This is happening to a dear elderly friend of mine. Her daughter does not think she had done anything wrong. This is fraud. What would you do? Have her arrested? Tell her husband and ask how they plan to pay it back? Thoughts ladies?

  • Tis the risk one takes when entrusting her money/credit to anyone but oneself. If it were MY daughter, I would call the FBI. The punishment for this crime is much worse when done to an elderly person....

    I have a friend whose wife "borrowed" an elderly woman's credit card to purchase new furniture. She was facing MANY years in prison with these charges, specifically, because it was a crime against an elderly woman....HOWEVER, she was able to show proof that she was making payments toward the charges. DESPITE, "proof" (canceled checks to the victim) it was a "loan" - she still had all of the furniture taken away, had to pay restitution to the woman, fines, community service, and is on probation. And I swear, it's also because of the incredible attorney I hooked them up with.... (I did it for my friend's sake and for their children's sakes...I would have loved to see the wife rot in jail)

  • Sit down with her and ask her how and when she plans to pay it back. TAPE THE CONVERSATION> If done before involving the authorities, she will admit all over the place that she did it. Take the tape to the police then, and have her arrested for fraud and embezzlement and robbery and anything else you can think of. The tape probably won't be admissable in court, but it's enough probable cause to get the police to arrest her skanky thieving ass.

  • What situation does this put your friend in for future emotional and financial support? Did the daughter feel she was just borrowing her own inheritance? Is the daughter capable of paying it back? Is there another sibling that can help mom? Are you willing to help your friend with her finances?(just the paperwork part.) Does this wipe your firend out, or is she worth millions? Does this woman live on her own? Or in a nursing home? Is she capable of driving and cooking for herself?
    The daughter is clearly a greedy idiot, but that is the whole story. If your friend honestly needs help and her daughter can't be trusted who can? Too big a question for this little space.
