  • You'd probably be held in contempt of court and sit for awhile in a jail cell until you wanted to cooperate with the proceedings. You can only plead the 5th if your testimony will incriminate yourself.

There was actually an episode of Bones where Brennan's father is on trial and Angela refuses to testify against him and tries to plead the 5th but is denied (since she is testifying about things she saw another person do that had nothing to do with her). She spends the rest of the case in jail because she won't comply with the subpoena.

  • You'll be treated as a hostile witness? I don't know. I saw it on tv once.
