Custody and CPS Question

Bio-father has not been in my 4 year old's life. He recently requested custody and was granted custody by the court. He filed for custody without having seen her since she was 5 months old. The visits are not going well. My daughter bumped her head at the playground and has a tiny bump on his head. This is custody period Wednesday 4-8 and every other saturday 9-6. He just called me just now and said that he is calling the police and CPS on me for the bump on her head. Just wondering what CPS will do....I have never dealt with this before, this is all new to me.

  • If all it is just a bump on the head they aren't going to do anything that is what toddlers do

  • CPS and the police will ask you what happened and what you did about it. Tell them the truth. 4 year olds are very active and CPS knows the kinds of accidents they have.

  • CPS will interview your child, ask questions that are acceptable for his/her age range, that don't require yes or a no. Usually questions like what do you do during the day with your mom/dad? How do you like it? What fun things do you do?

Your child will also likely see a doctor for the bump. Doctors are damn good at knowing accident from on purpose, good at knowing when a story doesn't match the injury. So as long as that's really how he got the bump you have nothing to worry about.

Try to be as civil as possible, remember custody is not about you, not about your ex! It's about your child, your child deserves to have a relationship with you both. It would really suck if either of you got really petty about things. : (

    Good luck.

  • Wow! Umm if he hasn't been around not sure why they granted him custody. Thats just odd. As for CPS kids get bumps and bruises all the time, it's part of being a kid. They know this. If called they are required to "investigate" you for a month. They will make a few visit if everything is fine they will tell you they are filing the case as "unfounded" and that will be all you hear out of them.Any thing they are unsure of they will mention. They will also check in with your pediatrician and see if they have any concern and they will want to inspect your daughter for not normal bruising or whatever. However, they will always, have a file on you but that is just cause of how they run. If you are providing everything for her to the best of your means you have nothing to worry about.
