Age of Consent laws vs Marriage

Say a little girl is awarded to a husband at age 12. The Age of Consent law for the country they're in says age 14, no matter gender or orientation or act.

Is the husband allowed to "technically" rape and sodomise the child since they are married? Or can the law criminalize him for doing so?

  • matobe, the best place she can be right now is in that safe house and not let her family know where she is. She NEEDS to go to the police department. Honor killing is NOT Islamic where is her family from? Her family has a very twisted view of Islam and your friends needs to know her rights. Tell her that Allah swt has given every single woman the right to be taken care of, loved, respected and honored and what has been done to her is not her fault and is not acceptable. She has a responsibility now to protect her sister because her sister is being denied her rights by her parents, she is her sisters voice right now. She needs to go to the police department, I can't say that enough that she needs to go to the police department and she needs to contact an Imam for support from the masjid educational, finincial and emotional.

  • Good question. That's like legal age in some states are 17 but with parents consent you can marry at 14.

    Muslim culture is to marry young, of course, but to consummate and begin raising a family immediately after the first menstrual cycle. However, they are not in a muslim country, and I wondered if there was anything the little girl could do to protect herself?

For all you know, she personally knows a young girl about to be forced into marriage - which DOES happen, regardless of what you like to believe.

  • DusterMommy, You have the attitude here, I didn't say anything antanogistic to her. I answered her question clearly and said that the young lady doesn't need her help to protect herself. She has everything as a Muslim to protect herself, the actual question should be by Matobe how can I empower the Muslimah in her rights so when she is ready to consent she makes an informed decision and enters into a loving and caring marriage.

    The way you wrote "protect" in quotations, followed by "she doesn't need your help" implies an attitude. You seem to be offended because she dared imply someone who is Muslim might need help from some kind of oppression. Sorry.
