Am I liable?

I accidentaly backed into a car (which was not parked in a proper parking zone) in a private parking area am I still liable?

The police officer couldn't even give a parking ticket or make a police report because it was a private parking area.

I am not so sure I am responsible though.

  • I would venture to guess not but laws change state to state. If the cop could not issue a ticket you should be okay...

  • state laws do apply here, in oregon we are a no fault state so both parties are liable. Here's hoping that your not because they werent parked correctly. Good luck

  • Just because the police didn't ticket, it doesn't mean that you aren't liable for the damages you did to the other car. Where I work, there was a car that was parked illegally in our work parking lot. A coworker (not expecting the car to be there) hit it. Since that car was not moving, my coworker was still liable. No ticket was issued to either my coworker, or the illegally parked car, but her insurances had to cover the damages.

  • Yes, usually you're liable if you hit something that was standing still.

  • Yes. You most likely you are. You hit another car, whether or not it was parked legally.

    The best way to tell though is to call your insurance agent and ask.
