What is the law on who's responsible?

I have two neighbors that both have dogs. One (the male) is ALWAYS on a leash when outside, the other (lady in heat) is NEVER on a leash when let out. Both dogs live on opposite sides of the building. The female made her way over to the other side and both dogs began to do their thing. The owner of the female dog came over about 15 minutes during the episode and started to lay into the other owner about her having to pay for the puppies if her dog (the one who in NEVER tied up) gets pregnant. Is the owner of the dog liable if hers was on a leash and the other was running around? Or is she liable because it would have been her dog being the father. I don't know where to look for info on this.

  • Well seeing how most states have a leash law I would think the owner with the dog who wasnt on the leash is responsible. IMO good luck on finding the answer though!

  • I don't think it is a question or liability or who is legally responsible, the one who does not leash the dog should take responsibility for the unintended prego dog.

  • she's an idiot, i'll bet there's a leash law in your city that prohibits dog's from running around the neighborhood without a leash. if she's going to have an animal she needs to watch it, plain and simple. the other owner did his best to make sure his dog was safe and that other's were safe. if her dog bit someone it would be her fault.

  • Don't know the laws, but my opinion is that the dog not on the leash is at fault. It would also be the owner of the female dog to take care of the puppies because she should have gotten her dog fixed and this wouldn't even be an issue.

  • I quite agree with all of you on where the responsibilty stands. The owner of the male dog is freaking out, and I just wanted some info to reassure her.

  • The owner whose dog was NOT on a leash should be responsible.. But it is very hard to prove a dog is the father, lol.. Unless she wants to get a DNA test done on the pups or whatever which would be ridiculous, lol.. Sounds like she just needs to get adopt the puppies out and get her dog fixed if she doesn't want to run the risk of having puppies.

  • i would think that if there is a leash law the owner of the female (who also failed to spay their dog) would be responsible for the puppies.

  • Leash law "should" come in effect. Call the animal control in your area and talk to them.

  • the idiot that lets her dog in heat run loose is responsible! hasn't she heard of leash laws? Some areas are also making it illegal to let an unfixed dog run loose too.

    If she didn't want her dog pregnant, she shouldn't have let it run loose while in heat.
