If 2 High School age kids are dating and one hits 18, is the 18yo now breaking the law?

I always wondered about that. Say its 2 HS kids. 16-17 and one of em hits 18 during the school yr, does the 18 yr old now have stop and desist all dating until the partner also hits 18?

Or does this law only apply to sexual activity?

  • Depends on the state. Some states say they can't be alone some states only specify sexual activity.

  • Most states have a three year law, that says if they're three years apart, they can be together..

  • In our state there is a law that says if they are with in a year of age from each other they are okay... Of course here the consent age is 17.

  • What 16 & 18 yr olds do you know that aren't engaged in some type of sexual activity when dating? In most states the age of consent is 16 not 18 so I think it'd be more of a problem w/ a 14 yr old & a 16 yr old & only if they are having sex, oral does count, & usually only becomes an issue if the parents of the underage-usually girl-doesn't like the boy & presses charges.

  • i think the law is fine with it as long as the kids are less than 4 years apart if they are 16

  • so short of getting pregnant or in plain sight, there's no way to know if they are having sex.

    as far as dating, that would be hard to prove, they could just claim to be friends hanging out (if seen walking at a mall for example)

  • Depends which state - call your local enforcement agency and get the right answer from them. I know in FL its a No-No because we just had this issue with a couple of senior football players and they got screwed out of their scholarship, etc., because they were brought up on Sexual Abuse charges as they were 18 and the girls were 17.

  • In ny it applies to sex only, and 17 is the legal age.
