house taxes credit

We buyed a house got the tax credit, and are now looking to get divorced and we havent owned our house for 3 years, are we gonna have to pay it all back??

  • 6. Recapture: Buyers have to own the home for at least three years in order to capitalize on the credit. If they sell the home before then, they will have to return the credit to the government. (Exceptions will be made in certain cases, such as death or divorce.)

    Look like you have to live in the home at least 3 years.

  • okay maybe im stupid my english isnt that great but says exceptions will be made in cases such as death or divorce wouldnt that mean no she wouldnt have to pay it back
