  • get proof. a voicemail recording or an email or verbal with witness. You can't get sole custody without that or if the child testifies about the threat which can be a little traumatizing. First get proof or and then pursue custody. But get the restraining order in the mean time.

  • 1st was there a paternity test? If not demand one from your state offices Then when the paperwork is done as long as you have the child you can demand sole custody. If he has a record you can bring it up at that time. IF he admitted to being the father when the paperwork was done they should've given you full custody based on living situation of the child. If neither was done he has no legal right to the child. tell him to get bent...you don't have to allow any contact.

  • You weren't married so he is not automatically the father by law. If he is on her birth certificate, you need an attorney or advocate. In most states your local YWCA has a worker that can help you do the paperwork yourself. Restraining orders only work if he has a record of domestic violence against you or the child.
