so i tried making an arrangement with my ex to pay child support and he agreed to pay weekly but no more than 25-50 dollars a week. he says a baby doesnt need much right now cause we dont pay for formula. is that fair? i dont know what a good amount is....help

  • Child Support is not only for the baby's personal needs, it is also to help provide a home for the child. I'd take it to court and let them decide the amount based on his income. Even a father who is unemployed has to pay at least $50 a week!

  • Let the courts figure it out! $25-50 a week? No accept less than $100 a week!!! You can always put the rest aside for a rainy day Or start a bank account for the baby!!!! Is he serious. Well at least it's something but there is also diapers and other stuff that add up. What you need to do is see wha you spend a week on the baby. I guess you can go by that!

  • The court should decide that way there will be no deciding later that you really don't need the money etc. It is a cut and dry business arrangement.

  • I agree, go to court. Be realistic with your expenses, though. The more money you have for your child whether they 'need' it or not the better!

  • I meant DON'T accept less than 100 a week. Do you know how much he makes because it should be 17% of that.

  • The amount that your child is owed will depend on the guidlines set by your state. Here in CA it is determined by both parents' incomes and custody schedule. So, if your state goes by that and he sees his child frequently and makes less than you then you might only get a couple hundred a month. It just depends. DH pays what works out to about $6 a day, and that is paying her about a $100 more than she should be getting a month because she makes more money and has fewer dependants.The order was established before she started making about a $1000 more a month, whiile DH is only making a couple hundred more.
    I'd get a court agreement, it is good for the both of you so that neither of you can take advantage of the situation.

  • Just go to court. If you two come to a "mutual agreement" and dont have it done through the courts he can stop paying at any time and there will be nothing you can do about it except go to court for it. so instead of waiting for that to happen, just go ahead and do it now. you shouldnt need a lawyer. child support is pretty cut and dry. based off how much time you both have with the child and a percentage of how much he's making. and you'll definitly get more then $25 a week.
