can u sue?

can u sue if u have a homebirth and something happens to u or ur baby? can u sue the midwife or whatever?

  • There is usually a clause in a contract somewhere that either allows you to sue up to a specific amount, or a clause that you cannot sue at all, as you are giving up all rights to do so. Sometimes it is written in the contract somewhere where they do not have liability insurance and yes they can be sued; but it depends who you can sue against; the company or the individual... I hope you had a contract with the midwife/company she works for....

  • Yes prettyrayray; but in the documents filled out when selecting an OBGYN for instance, it is usually stated that "Hey, you can sue us, but you can only go up to $200,000." Unfortunately the doctors get this liability insurance to protect themselves and their business, as lifetime health care for a child could cost millions of dollars, and they certainly do not want to foot the bill, even if it is their fault..

  • i know that if you go to a doctor and the problem could've been prevented then you can sue but if you chose to have a homebirth then i dont think you can!of course im no expert but as far as i know you cant!
